"Horus VS. Creature Swap"

Hello Everyone,
The Topic of the day is "Creature Swap" Vs. "Horus Dragons". And the question is, can I do this or not? Yes or no? And Why? I have talked about this with many judges, and I have gotten yes and no's like crazy.
Quesiton: If I have either Horus 4,6, on my side of the field and my opponent has a monster can I activate creature swap and take thier monster? My reasoning is Yes, because The Horus monster state " Control can't switch", But it doesn't say you can't activate them, so I would think you can, and you would take thier monster, and they could not take mine.

-Level:4: "ong as this card remains face-up on your side of the field, control of this card cannot switch. During the End Phase of a turn that this card destroyed a monster as a result of battle, send this card to the Graveyard to Special Summon 1 "Horus the Black Flame Dragon LV6" from your hand or Deck."
-Level 8: "This card cannot be Normal Summoned or Set. This card cannot be Special Summmoned except by the effect of "Horus the Black Flame Dragon LV6". As long as this card remains face-up on your side of the field, you can negate the activation and effect of any Spell Cards and destroy them."
-Creature Swap: "Both players select 1 monster on their respective fields and switch control of them to each other. The battle positions of these cards cannot change during the turn this card is activated."

You cannot activate a Creature Swap if both players do not have a valid target on the field. Level 4 and Level 6 can't be valid targets but feel free to Swap your level 8.

As anthony correctly stated horus level 4, 6 can not be swapped

Horus Level 4 can not be change control as such if it is the only monster on your side of the field you can not activate creature swap (it wouldn't be a legal target)

Horus Level 6 is not effected by spell cards. if it is the only monster on your side of the field you can not activate creature swap as is it not a legal target for that spell.

Horus Level 8 may be creature swapped (though imo this would be foolish) bare in mind horus lv 8 can also negate creature swap

If your opponent ONLY has:

Horus the Black Flame Dragon L4: Make sure it's face-down, then CSwap it.
Horus the Black Flame Dragon L4: Make sure it's face-down, then CSwap it.
Horus the Black Flame Dragon L4: Make sure it's face-down, then CSwap it.

Basically -- make sure it's face-down, then CSwap it.

And don't say it can't be done people -- there is this nice little monster I like to call Tsukuyomi.

The battle positions of these cards cannot change during the turn this card is activated. <-- does that mean you cant use eg Book of Moon on a monster after you switched it to the enemy?

Otherwise this (unrealistic) combo would work:
Tsuku --> f/d horus 4/6 --> creature swap horus vs other mon --> book of tayou --> horus 4/6 f/u --> u get monster, enemy nothing

*looks at Dlanaan's post*... That would be correct... Refer to post below... though seriously with LV6 (1600 DEF) and LV8 (2500 DEF) I wouldn't be too concerned unless they had something more powerful on the field... which I somewhat doubt if they run Horus deck...

Creature Swap refers to manual position changes. Book of Moon, Book of Taiyou, the effect of Goblin Attack Force, Final Attack Orders, etc. will all still work properly on a monster affected by Creature Swap.
