Upper Deck Wins Major Victory in Support of Worldwide Yu-Gi-Oh! Players

This is from UDE's site, so I guess Konami is not taking over the TCG after all:

1Upper Deck Wins Major Victory in Support of Worldwide Yu-Gi-Oh! Players

U.S. and International courts side with Upper Deck in multiple legal actions involving Konami and the future of Yu-Gi-Oh! Trading Card Games.

North Las Vegas, NV (December 27, 2008) – A California court has denied Konami’s application for a temporary selling and shipping ban, effectively stopping any restrictions that would have prevented Upper Deck from marketing, selling, distributing and providing game support for the Yu-Gi-Oh! trading card game.

The Dutch courts also ruled in favor of Upper Deck, overruling Konami’s alleged termination of its contract with Upper Deck. Accordingly, Upper Deck will continue its role as the exclusive distributor of the Yu-Gi-Oh! trading card game in all European territories, plus Australia and New Zealand. The complete release announcing this decision can be found at http://www.upperdeck-international.com/tabid/56/language/en-US/Default.aspx?AnnouncementID=11

Both victories clear the way for Upper Deck to continue distributing, marketing and selling Yu-Gi-Oh! TCG products in territories outside of Asia. “Upper Deck is very pleased with today’s rulings”, said Upper Deck executive Bernd Becker. “We look forward to continuing the superior game support that we’ve been delivering to worldwide Yu-Gi-Oh! players for the last seven years."

The unparalleled game support Upper Deck has provided to dedicated Yu-Gi-Oh! players around the world has led to another successful year for the trading card game, as evidenced by the current product sell-out. "This is as much a victory for the Yu-Gi-Oh! players as it is for Upper Deck," said Becker.

Told you that both sides would have spin doctors put their own touch on the news... The point is, it is just that, spin...

Oddly, I actually may have run into some of those forums. But does it matter? It's easy to get lost in the details of who we like or who we don't and forget that this is about someone counterfeiting cards. If Upper Deck was in on that, I don't blame Konami for being mad. If they weren't, well, that will hopefully eventually come out in court, too... It's early days yet, very early days... So far the only definite undisputed fact is that fake cards made their way into the stores and got sold as genuine product. The entire rest of this is up in the air, and probably will be until the court case actually gets heard months or years from now.

And getting stuck with fake cards from a trusted source is bad. I'm now looking at all my little squares on everything. Just. In. Case. And holding cards sideways trying to decide if the coating is shinier than usual or not -- I have a Sky Scourge Enrise I'm now feeling doubtful about, that I bought in a similar blister pack, at who knows where? -- Walmart? Shopko? Target? Toys-R-Us? -- and at who knows when? All I know is I remember buying it in a similar package at an entirely different time -- a couple of years ago maybe... And the little square is okay, but the card looks shinier than normal.

My friend's daughter and I agreed it's rather like looking down at a tickle and finding a spider on your leg -- for another hour you keep imagining tickles that aren't there. We are both looking doubtfully at all our cards, wondering, now....

Yeah, this is definitely what we want to read after using UDE's YGO site for so long.

"This is a great victory for Duelists..."

Hmm, which forums are they reading that made them think that?
well, the way I see it, aside from gameplay being down currently, I'd love to see Konomi take over. Maybe then we could get some decent translations. Not to mention the Japaneese cards are of a much higher quality then the UD ones. I mean wouldn't it be great to have some cards that didn't warp in the slightest bit of humidity?:peace:

From what I understand, Konami is te one screwing up the translations. UD has always had to go to bat for us for erratas, and saying....hey, that doesn't make sense in light of the templating. In fact Konami doesn't even like the concept of templating. Look what they did to Gadget Driver and Gadget Hauler. The one that reads like it is a cost isn't and vice verse.

As for the quality of cards, I agrre those are pretty chincy, but doesn't Konami control the printing? It's not like UD owns the print shop. There is nothing to suggest that Konami will find another printer.

So now, just for fun, the whole mess from a lawyer's point of view...

I ran across the first of these by accident two days ago -- it has a link to the second:

and

http://www.vegastrademarkattorney.com/2009/02/upper-deck-sues-former-partner-konami.html

The second, by the way, has a card that looks to be made with Yugioh card maker, rather than a real card, in his example... And I'm "Starwefter" who posted the comment on his blog.

The first also has a link to the actual court documents Konami filed in California. Amongst other things it lists the names of the nine actual counterfeit cards:
  • Elemental Hero Wingman
  • Elemental Hero Aqua Neos
  • Elemental Hero Mudballman
  • Elemental Hero Electrum
  • Destiny Hero Dreadmaster
  • White Horned Dragon
  • Mist Body
  • Water Dragon
  • Flute of Summoning
My guess is the last is Flute of Summoning Kuriboh, since these seem to all have come from the second McDonald's promotion.

The court document is lengthy, but readable, and rather fascinating.

Maybe, maybe not -- I have one fake White Horned Dragon, and one real one. Go figure. My fake has the Yugioh logo in the bottom right corner printed sideways. I think this happened on some, but not all the fakes -- however if it says limited ed. the little square holograph should be gold, on the fakes it was silver even though they read limited ed.

Keep in mind not all silver holos are fake, open edition cards have silver holos. 1st ed. cards and (apparently) limited ed. cards have gold, and after that you've exhausted about all my card knowledge; you'll need to talk to someone who's way more experienced at identifying cards than I am for more info.

But if the word "Yugioh" and the Millennium Eye symbol in the hologram is running up and down (vertically) instead of side to side (horizontally), it's a dead giveaway that you have a bad card. Compare it with a cheap, common card. No one fakes a common, so you know the hologram is okay on that.
